Thread: Possible podcast/youtube weekly series - copyright problems?

Default Possible podcast/youtube weekly series - copyright problems?

    Hello all,

I've been thinking of setting myself the task of uploading regular video/audio of mandolin-related content. One idea I had was to learn then record the tabbed out songs in the Bluegrass Mandolin book by Jack Tottle. Specifically, the ones not included in the audio available for the book.

Do any of you think this would be a copyright violation? Or would it be okay if I just recorded it, but a copyright violation if I discussed some of the technical issues in the piece? (which I think could be interesting).

    Appreciate your thoughts.

That question is why there are lawyers.

What could go wrong with nonprofessional advice from an Internet forum?

As Bill says, that's why there are lawyers out there -and maybe on this forum too, of course. Have you thought of contacting Jack Tottle or his publishers, explaining your ideas for a podcast and saying whether it would be a money-earning scheme or just a hobby? If you are highlighting the work as his and giving him free publicity they may well agree to your request - but don't hold your breath! They are also likely to see it as a way for folk to get the notation from your site without having to buy Jack's books!

By the way, I am one of the non-lawyers on the forum.

Might be a good idea to contact Hal Leonard Publishing while you're at it. Part of their catalog and they own the rights to it.

    Thanks for the responses.

I was not planning it as a money-making scheme and also not planning to include the tab - I think the latter would clearly be breaking copyright. I just thought I'd like to learn some of the arrangements in the book, and setting myself the task of uploading the results might be good motivation to continue.

I can't imagine that I'm likely to be sued for playing the tune as written in the book - so I may go ahead and do that. I do think it might be useful to others to discuss some of the tricky sections, but I think for that it would be best to contact the publisher so we'll see if I get any response.

    All the best, Kenny.

On the copyright.gov site, there is an option to "Ask a Copyright Specialist" -- right now it is followed by "Chat is offline" ... but maybe later?

I am a bit confused. Are you uploading audio and video recordings of copyrighted pieces to a web page? Where are you getting this music? Then you mention learning and recording the arrangements from Jack Tottle's book and then discussing the technical aspects of playing it? Why do you need to upload the original recordings to a web page? I guess I am unclear of what your plans are.

The way I read it he is recording the tunes learned from the tabs in the Bluegrass Mandolin book. This book came with audio, but not for all the tunes so he is going to record and upload the ones that didn't come with audio for others to listen to, to help them learn. Correct me if I am wrong ampyjoe.

I have that book, but mine did not come with any audio files. Audio files would have been helpful for me.

Yes, exactly. The original book had a floppy record with some of the tunes/songs played on it. But it seems to me that some might be useful to have more recordings/videos of other tunes/songs tabbed out in the book. I have the book so I plan to pick a tune each week and record it, then upload it prob to mandolin cafe.

I think I'm going to go ahead with at least a few of these, as there are already quite a few YouTube videos out there of arrangements from the book. But I probably won't discuss the arrangements and I certainly won't upload tab as that's an obvious copyright violation.

It's just a little project for me. I think I'll find it quite difficult - and therefore I hope beneficial to my playing.

These are the (higher quality) sound files that are usually available with the book which I’ve seen on Amazon from 7 dollars with a lot of very good comments.
Apparently Jack himself was happy to have the sound files shared on the internet.

Not sure what the issues are with sharing TAB, though of course I personally would like to see it.
    Good luck with your project.

There's at least one excellent video of Slickville (Twin River rag) , from the book, on YouTube by Jordan Ramsey.

I believe as Simon says, that Jack has shared the sound files.
(I've had the book for forty+ years but lost the thin disk within months. I remember laboriously learning Woody's Rag from it and that was my first mandolin tune)
